Scope of Our Marketing Communications
At Hermanor, we engage in various marketing communications to keep you informed and engaged with our offerings. These communications include newsletters, promotional campaigns, product launches, and cart-recovery sequences. We may also send surveys to gather your feedback. Please note that strictly transactional communications, such as order confirmations, shipping updates, and password resets, are not considered commercial electronic messages (CEMs) under Canada's Anti-Spam Legislation (CASL).
How We Collect Consent (CASL §6)
We collect your consent for marketing communications through several touchpoints:
- Newsletter sign-up form
- Checkout opt-in checkbox (unchecked by default)
- Pop-up offers
- Customer service interactions where you indicate interest
Express consent: You actively indicate agreement by ticking a clearly-labelled, unchecked box to receive our marketing communications.
Implied consent (CASL §10(9)-(10)): Implied consent may apply for up to 24 months after a purchase or 6 months after a written inquiry. We do not assume implied consent beyond these limited grounds.

Every commercial electronic message we send identifies us clearly:

Functional Unsubscribe Mechanism (CASL §8 + §9)
Each CEM contains a free, functional unsubscribe link (in emails) or instructions (e.g., reply STOP for SMS). We process unsubscribe requests within 10 business days as required by CASL §9. After processing, you are removed from all promotional lists. Your unsubscribe applies across all marketing from us unless you have granted separate consents for distinct channels.

Consent Registry (CASL §11)
We maintain a registry of consent events — date, time, channel, method, and the specific text shown at the point of consent — so we can demonstrate compliance if challenged. Records are retained for the minimum period required by CASL (three years from the last marketing action) and our Privacy Policy retention rules. This registry is available for your review upon request to heermanor@outlook.com.
Withdrawal of Consent
You may withdraw consent at any time by:
- Clicking the unsubscribe link in any CEM
- Replying STOP to any SMS
- Emailing us at heermanor@outlook.com
We process withdrawal within 10 business days. Withdrawing marketing consent does NOT affect order-related communications you continue to receive for purchases you make.
If a Message Was Sent to You in Error
Please contact us at heermanor@outlook.com. We will investigate and ensure no further messages are sent.
Penalties (Disclosure)
Violations of CASL may result in administrative monetary penalties of up to CAD 1,000,000 (individual) or CAD 10,000,000 (corporate) per violation. We take CASL compliance seriously.
CRTC Escalation
If you believe we have violated CASL, you may file a complaint with the Spam Reporting Centre at fightspam.gc.ca or contact the CRTC at 1-877-249-CRTC (2782).
